DMCA/COPYRIGHT POLICY

1. INTRODUCTION
Gains & Gears ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our website, Discord community, or related services.
This policy outlines the procedures for reporting copyright infringement and how we handle such notifications.
2. COPYRIGHT INFRINGEMENT NOTIFICATION
If you are a copyright owner, or authorized to act on behalf of one, and you believe that your copyrighted work has been used or displayed on our website or Discord community in a way that constitutes copyright infringement, please send a notification containing the following information to our designated copyright agent:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has allegedly been infringed;
- Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works;
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including the URL or other specific location on our services where the material appears;
- A statement made in good faith confirming that the use of the content is not authorized by yourself, your agent, or the law and that you request that the content be removed;
- Your contact information, including your address, telephone number, and email address;
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
3. DESIGNATED COPYRIGHT AGENT
To submit a copyright infringement notice, please contact us through our official communication channels. We will respond to valid DMCA notices in accordance with the law.
4. COUNTER-NOTIFICATION PROCEDURE
If you believe that your content was removed by mistake or misidentification, you may submit a counter-notification to our designated copyright agent. After receiving a counter-notice, we are obligated to forward that counter-notice to the person who sent the original takedown notice.
Your counter-notification must include:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or access to it was disabled;
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided the original notification.
5. REPEAT INFRINGERS
We reserve the right to terminate access for users who are determined to be "repeat infringers" of copyright. A repeat infringer is a user who has been notified of infringing activity multiple times or has had infringing material removed from our service multiple times.
6. DISCLAIMER
The DMCA won't protect you from trademark infringement, violations of NDAs or trade secret laws, defamation claims, and other claims. If you receive a legal letter regarding something other than copyright infringement, don't rely on this DMCA Policy for protection.
7. FINANCIAL EDUCATION CONTENT
Our financial education content, including training materials, videos, and written guides related to options trading, cryptocurrency, sports betting, and real estate investments, is protected by copyright law. You may not reproduce, distribute, or create derivative works from this content without our express written permission.
